CVRD Files Court Proceedings for Ship Breaking

On Thursday, April 14, 2022 the Comox Valley Regional District (CVRD) filed a Notice of Civil Claim with the Supreme Court of British Columbia seeking assistance from the Court to stop ship breaking operations at 5084 Island Highway. The CVRD has received a number of complaints regarding the operations of Deep Water Recovery within its current location.

The CVRD Board approved seeking legal action during the February 15, 2022 board meeting to stop ship breaking on the subject property as that land use is considered by the CVRD Board to be contrary to Industrial Marine (IM) Zoning.

“We have heard and understand the issues that have been raised regarding the property,” explains Amanda Yasinski, Manager of Bylaw Compliance. “The operations on the property are not allowed under the current zoning restrictions.”

Now that a Notice of Civil Claim has been filed, the property owner and operators will have an opportunity in the BC Supreme Court to respond to the CVRD’s claim that ship breaking is not an allowable use within an IM zone. The Court process is expected to take several months or longer before the issue is resolved.

The Comox Valley Regional District is a federation of three electoral areas and three municipalities operating on the unceded traditional territory of the K’ómoks First Nation, the traditional keepers of the land. The members of the regional district work collaboratively on providing sustainable services for the benefit of the diverse urban and rural areas of the Comox Valley.
